Welcome to Bayarcash. These Terms & Conditions (“T&C”) govern the use of our services by merchants and end-users. By using Bayarcash services, you agree to comply with these T&C.

2. Definitions

• Bayarcash / We / Us / Our: The service provider managing payment, transaction, and related services.
• Merchant: A business entity using Bayarcash to accept payments or process transactions.
• End-User / Customer: Individuals making payments or using services facilitated by Bayarcash merchants.
• Services: Any payment processing, account management, reporting, or related services offered by Bayarcash.

3. Eligibility

• Merchants must be legally registered and authorized to conduct business in their jurisdiction.
• End-users must be at least 18 years old or of legal age in their jurisdiction to use Bayarcash services.
• By using our services, users represent that they meet eligibility criteria.

4. Account Registration

• Merchants and end-users must provide accurate, complete, and up-to-date information.
• Account credentials must be kept confidential. Any unauthorized access must be reported immediately.
• Bayarcash reserves the right to suspend or terminate accounts for non-compliance or fraudulent activity.

5. Use of Services

• Merchants must comply with all applicable laws, including anti-money laundering (AML) and sanctions regulations.
• End-users must use services only for lawful purposes and not engage in prohibited activities.
• Bayarcash may monitor transactions to detect fraud, illegal activity, or policy violations.

6. Fees & Payments

• Merchants are responsible for paying fees as outlined in the Merchant Agreement or SLA.
• End-users may be charged transaction or service fees where applicable.
• All fees are non-refundable unless otherwise specified.

7. Data Protection & Privacy

• Bayarcash collects and processes personal data in accordance with applicable data protection laws.
• Data may be shared with authorized partners, regulators, or service providers only as necessary to provide services.
• Users must review the Privacy Policy for detailed information on data handling.

8. Security

• Users must safeguard passwords, PINs, and account information.
• Bayarcash implements technical and organizational measures to protect information.
• Any suspected breach or fraud must be reported immediately.

9. Transaction Monitoring & Compliance

• Bayarcash monitors transactions for fraud, AML, and sanctions compliance.
• Transactions may be blocked or delayed if they appear suspicious or violate legal or policy requirements.
• Users acknowledge that Bayarcash may report suspicious activity to regulators without prior notice.

10. Liability

• Bayarcash is not liable for indirect, incidental, or consequential damages arising from the use of services.
• Merchants are responsible for ensuring compliance with laws and maintaining the accuracy of transaction data.
• End-users are responsible for ensuring lawful use of funds and services.

11. Termination

• Bayarcash may suspend or terminate accounts for policy violations, fraudulent activity, or legal obligations.
• Merchants and end-users may terminate their accounts according to procedures in the Bayarcash platform.

12. Intellectual Property

• All content, software, and trademarks of Bayarcash are proprietary.
• Users may not reproduce, distribute, or modify any Bayarcash intellectual property without written consent.

13. Amendments

• Bayarcash may update these T&C periodically.
• Changes will be communicated via email or platform notifications.
• Continued use of services constitutes acceptance of updated T&C.

14. Governing Law & Dispute Resolution

• These T&C are governed by the laws of Malaysia.
• Disputes will first be attempted to resolve through good-faith negotiation.
• If unresolved, disputes may be submitted to arbitration or courts in the jurisdiction specified.
